  4. PURCHASE CONDITIONS 

 4.1 GENERAL PROVISIONS 

4.1.1 Given conditions are valid for relations between buyers on audioport.eu and the owner of Internet shop audioport.eu, firm InfoAbi OÜ (further audioport.eu). 

 4.1.2 Except the present Conditions, the legal relations arising at purchase of the goods through audioport.eu, are regulated by legal certificates of the Estonian Republic.

 4.1.3 audioport.eu has the right to change and supplement the present Conditions of the goods. Changes of Conditions and price-lists are displayed on a site audioport.eu. Changes and additions of Conditions come into force from the moment of the publication on a site audioport.eu In case of placing of the order before coming into force of new Conditions, the Conditions operating at the moment of actual placing of the order, except cases when by the Law or the present requirements it is provided differently are applied.

4.1.4 Assortment of the goods and their price vary without the prior notification. 

4.1.5 audioport.eu have the right to give within the limits of spent campaigns of the discount for orders and-or any concrete goods.  

4.1.6 Contract of purchase and sale is considered the prisoner (come into force) from the moment of receipt of the sum of an advance payment stipulated in point 4.6 on the settlement account or its payments in cash desk audioport.eu 4.1.7 On the questions which have been not stipulated by the present Conditions, the parties are guided by operating legal certificates of the Estonian Republic. 

 4.1.8 Disputes arising between the buyer and audioport.eu in connection with orders and purchases dare the parties by negotiations. In a case not achievements arrangements, the parties have the right to address for protection of the rights or in Department of protection of the rights of consumers, or the Tallinn city court. At permission disagreements of the party start with the current legislation of the Estonian Republic.

 4.2 AVAILABILITY, THE PRICE-LIST AND THE DESCRIPTION OF CARDS OF THE GOODS 

4.2.1 audioport.eu is the dynamic system displaying a condition of warehouses-partners. The system updates the given conditions of warehouses and the price is not more rare than 1 time at an o'clock, on the basis of given by data flow warehouses. 

4.2.2 All prices on audioport.eu are specified in the Estonian crones, EEK.

4.2.3 All specified on audioport.eu the prices contain the tax applied to the Estonian Republic from a turn.  

4.2.4 audioport.eu bears responsibility for conformity of a commodity code and the price in cards of the goods.     

 4.2.5 audioport.eu does not bear responsibility  for reliability of the description and-or visual images of the goods in cards of the goods: audioport.eu broadcasts the data given by warehouses-partners which can contain errors and discrepancies. Manufacturers of the goods can change specifications without the preliminary coordination and the notification. 

4.2.6 Changes of quantity of the goods accessible to the order and the prices in cards of the goods come into force from the moment of the publication on pages audioport.eu.

 4.2.7 Term of delivery in cards of the goods is underlined in the working days.

 4.3 PLACING OF THE ORDER  4.3.1 audioport.eu accepts orders in the next ways:On the Internet, by means of automatic Internet system of registration of the order;Having sent the demand on info@audioport.eu  

4.3.2 Placing of the order is not the conclusion of the contract of purchase and sale. Only point 4.1.6 condition is the fact of the conclusion of the contract of purchase and sale and occurrence of obligations. 

 4.4 CANCELLATION OF THE ORDER  

4.4.1 Buyer in the right independently to cancel not paid and not delivered order, having established the corresponding status opposite to the erroneous order in the profile.  

4.4.2 Order will be automatically cancelled, if has passed term of its payment: For private persons - 2 working days;For legal bodies - 5 working days. 

4.4.3 In a situation of the goods which have ended in a warehouse and-or the changed price, point 4.12 of the given Conditions operates. 

4.4.4 In a situation of desire of the buyer to cancel the order after payment, but before delivery, point 4.12 of the given Conditions operates.   

4.5 PERFORMANCE OF THE ORDER  

4.5.1 Order is carried out only after advance payment reception (see point 4.1.6) if with the buyer it is not stipulated differently.  

4.6 PAYMENT OF THE ORDER 

4.6.1 Buyer can take advantage of the right to order from 50 % an advance payment (VÕS §213 items 4). In this case to receive the order probably only at office audioport.eu, having paid on a place at order reception the remained 50 % cash or bank remittance. 

4.6.2 Possible ways of payment: From a site audioport.eu, through the reference to Internet banks *;Bank remittance (under the account) *; Credit card. 

4.7 DELIVERY AND GOODS TRANSFER 

4.7.1 Buyer can choose a variant of reception of the order convenient for: After goods receipt on a warehouse audioport.eu, and receptions of the corresponding notice to order delivery in any point of Estonia. Delivery is carried out on specified in cards of the goods to terms. The specified terms - maximum, in practice delivery is carried out faster. In exceptional cases occurrence of any problems with order delivery in time, the buyer will be immediately notified on it by service department audioport.eu:Depending on the goods delivery is carried out by express services ELS Kuller or independently to take away in the nearest branch Eesti Post.Delivery is carried out on the working days from 9.00 till. The courier always preliminary calls to specify delivery time.  NB! In case of excess of term of delivery we ask to contact service department necessarily! 

4.8 PACKING 

4.8.1 audioport.eu recommends to store original packing of the goods in case there will be a necessity for warranty service ― such are requirements of some manufacturers. From the goods and packing it is impossible to delete a serial article number, or other important information necessary for identification of the goods. 

4.9 IMPOSSIBILITY OF DELIVERY OF THE GOODS 

4.9.1 In case the price of the goods has changed or it has ended physically and in this connection delivery on the term specified in the order becomes impossible, audioport.eu will notify the buyer on a delay under the contact data specified in the order. In the notice it will be specified or about a delivery blank impossibility, or about offered new delivery terms of the ordered goods. In case the offered conditions will not satisfy the buyer, it have the right to cancel the order. Point 4.12 of the given Conditions in this case comes into force. 

4.10 RETURN OF THE GUARANTEE GOODS 

4.10 In case of impossibility of repair or replacement of subjects of a guarantee of commodity positions, the buyer is notified on it point

4.12 of the given Conditions comes into effect. 

4.11 RIGHT OF REFUSAL OF THE CONTRACT  

4.11.1 If for any reasons the got goods do not approach, the buyer has a possibility within 14 calendar days from the date of goods reception to break off the purchase and sale contract (VÕS §56 points 1 and 2).  

4.11.2 the Returned goods should not be used, and also to be in original packing: At fact finding-out use the goods audioport.eu adheres to a rationality principle i.e. if for finding-out of suitability of the goods it is necessary for testing in that case the goods are considered not used;The consumer should open original packing of the goods cautiously and without damaging packing. If packing not opening the returned goods should not be in original packing;On the goods there should be all factory labels, including serial number. 

 4.11.3 14-day right of refusal of the contract does not operate with reference to following goods: The goods which are made counting upon personal needs of the consumer or on special conditions by the given consumer;Audio and videorecordings, the software in case the consumer has opened packing and-or activated a product;Newspapers, magazines and the other periodical press. 

4.11.4 In case of desire of the buyer to take advantage of the right to break off the purchase and sale contract, it should within 14 calendar days from the date of goods reception notify audioport.eu on the desire by e-mail info@audioport.eu , having put goods and packing photos audioport.eu reserves the right to itself to demand granting of additional photos of the returned goods. 

4.11.5 Buyer agrees to bear the postage on return of the goods at the rate to 156,46 EEK (10 EUR, from calculation 1 EUR = 15,6466 EEK), excepting cases when the returned goods do not correspond to the ordered. 4.11.6 At contract cancellation it is necessary immediately (but not later than through 30 calendar days) to return the bought goods.  

4.11.7 Buyer agrees with possible refusal of its further service audioport.eu in case of abusing possibility of the given point of Conditions. 

4.11.8 In case of desire of the buyer to take advantage of the right to break off the purchase and sale contract, after goods returning point 4.12 of the given Conditions comes into force.   

4.12 RETURN OF THE PAID MEANS   audioport.eu Offers the buyer on a choice following variants of use of the financed means: Exchange for other desirable goods, with recalculation of cost of the order; Transfer of the paid means into the bonus account of the client in system audioport.eu;Return of the full sum of the paid means for the settlement account of the client. Payment is made only by non-cash transfer, and only into the account with which order payment has been made. Payment is made not later than in 30 calendar days after reception of the statement of the buyer.

7. RESPONSIBILITY AND FORCE MAJEURE 

7.1. audioport.eu answers before the client, and the client answers before audioport.eu for a damage put to other party by infringement of the present Conditions in cases and in volume, established by the legislation of the Estonian Republic.  

7.2. audioport.eu is not responsible for the damage suffered by the client or a delay of delivery of the goods in case the damage or a delivery delay are caused by circumstances which audioport.eu could not affect and which approach audioport.eu did not expect and could not expect.     1.     * - from 18.05.2009 in Estonia restriction in 3 000, - ЕЕК on payment through Internet bank operates at use password cards (detail). We recommend to use for an input in Internet bank the Id-card, the PIN-CALCULATOR or system Mobiil-ID.  If your limits do not allow to pay all sum for once, you have 2 possibilities to pay the order:To choose a variant "to pay later bank remittance" and to pay the order parts within several days (each time specifying number of the order and a serial part of payment: for example tellimus XXXXX, osamaks 1)To pay the order in bank office.
